Navy Guidance Following Court Ruling on DADT

The Navy’s current, official guidance concerning homosexuals serving on active duty and the Reserve. As the NAVADMIN states, current military laws, regulations and policies are being reviewed to, for lack of a better word, adapt said laws, regulations and policies for the gay Servicemember.

A note I would like to highlight from the message; “WE NOTE FOR SERVICEMEMBERS THAT ALTERING THEIR PERSONAL CONDUCT IN THIS LEGALLY UNCERTAIN ENVIRONMENT MAY HAVE ADVERSE CONSEQUENCES FOR THEMSELVES OR OTHERS SHOULD THE COURT’S DECISION BE REVERSED.”

UPDATE: According to Reuters, the 9th U.S. Circuit Court of Appeals has temporarily reinstated the of ban on gays in the military.

UPDATE: On Nov. 1, 2010, the U.S. Court of Appeals for the 9th Circuit voted 2-1 to extend the stay (throughout the appeal process) on the lower judge’s ruling that put an immediate suspension on the law. NAVADMIN 362/10, copy of which is in this posts comments, provides additional guidance for the Navy.

From the 20th edition of the Bluejacket’s Manual (US Naval Institute: 1984 printing),

“There are a lot of mistaken ideas about homosexuality. Some examples: a homosexual can be detected by speech characteristics, manner or dress. (This is not true in most cases.) VD cannot be contracted through homosexual acts. (It can, and frequently is.) The Navy will “cure” homosexuals. (The Navy does not have the facilities or personnel for this; and even if it did, treatment is not always successful.)“

RMKS/1. ON 12 OCTOBER 2010, A FEDERAL DISTRICT COURT JUDGE ISSUED A JUDGMENT AND INJUNCTION BARRING ENFORCEMENT OR APPLICATION OF SECTION 654 OF TITLE 10, UNITED STATES CODE, COMMONLY KNOWN AS THE DON’T ASK DON’T TELL STATUTE. THE DEPARTMENT OF JUSTICE IS SEEKING TO HAVE THE INJUNCTION LIFTED AND IS APPEALING THE CASE. HOWEVER, AT THE PRESENT TIME, COMPLIANCE WITH THE INJUNCTION IS REQUIRED THROUGHOUT THE NAVY. TO ENSURE AWARENESS BY ALL COMMANDS, THIS MESSAGE PROVIDES, VERBATIM, THE KEY PROVISIONS OF THE INJUNCTION AND IMPLEMENTING DIRECTION FROM THE OFFICE OF THE SECRETARY OF DEFENSE.

2. THE INJUNCTION STATES THAT THE COURT “PERMANENTLY ENJOINS DEFENDANTS UNITED STATES OF AMERICA AND THE SECRETARY OF DEFENSE, THEIR AGENTS, SERVANTS, OFFICERS, EMPLOYEES, AND ATTORNEYS, AND ALL PERSONS ACTING IN PARTICIPATION OR CONCERT WITH THEM OR UNDER THEIR DIRECTION OR COMMAND, FROM ENFORCING OR APPLYING THE DON’T ASK, DON’T TELL ACT AND IMPLEMENTING REGULATIONS, AGAINST ANY PERSON UNDER THEIR JURISDICTION OR COMMAND;” AND “ORDERS DEFENDANTS UNITED STATES OF AMERICA AND THE SECRETARY OF DEFENSE IMMEDIATELY TO SUSPEND AND DISCONTINUE ANY INVESTIGATION, OR DISCHARGE, SEPARATION, OR OTHER PROCEEDING, THAT MAY HAVE BEEN COMMENCED UNDER THE “DON’T ASK, DON’T TELL” ACT, OR PURSUANT TO 10 U.S.C. 654 OR IT’S IMPLEMENTING REGULATIONS, ON OR PRIOR TO THE DATE OF THIS JUDGMENT.”

ON 15 OCTOBER 2010, UNDER SECRETARY OF DEFENSE (PERSONNEL AND READINESS) ISSUED A MEMORANDUM FOR SECRETARIES OF THE MILITARY DEPARTMENTS WITH THE FOLLOWING DIRECTION: “YESTERDAY, THE DEPARTMENT OF JUSTICE FILED AN APPEAL FROM THIS INJUNCTION AND THE COURT’S EARLIER DECISION THAT SUPPORTS IT, AND IS SEEKING A STAY OF THE INJUNCTION WHILE THE APPEAL IS PENDING. IN THE INTERIM, THE DEPARTMENT OF DEFENSE WILL ABIDE BY THE TERMS OF THE INJUNCTION. IT IS POSSIBLE THAT A STAY OF THE INJUNCTION COULD BE ISSUED VERY SOON, PERHAPS IN A MATTER OF DAYS. IN THAT EVENT, I WILL ISSUE ADDITIONAL GUIDANCE. THE SECRETARIES OF THE MILITARY DEPARTMENTS SHALL ENSURE IMMEDIATE COMPLIANCE WITH THIS MEMORANDUM. IT REMAINS THE POLICY OF THE DEPARTMENT OF DEFENSE NOT TO ASK SERVICEMEMBERS OR APPLICANTS ABOUT THEIR SEXUAL ORIENTATION, TO TREAT ALL MEMBERS WITH DIGNITY AND RESPECT, AND TO ENSURE MAINTENANCE OF GOOD ORDER AND DISCIPLINE. 4. IN MARCH 2010, THE SECRETARY OF DEFENSE ESTABLISHED A COMPREHENSIVE REVIEW WORKING GROUP (CRWG) TO ASSESS THE IMPLICATIONS OF A POTENTIAL LEGISLATIVE REPEAL OF 10 USC 654. OVER THE PAST FEW MONTHS, THE CRWG HAS REACHED OUT TO OUR FORCE AND OUR FAMILIES TO UNDERSTAND THEIR VIEWS, AND MANY SAILORS CONTRIBUTED TO THIS EFFORT. I AM GRATEFUL FOR YOUR THOUGHTFULNESS AND PROFESSIONALISM. THE CRWG CONTINUES ITS EXAMINATION OF POTENTIAL CHANGES TO POLICIES AND REGULATIONS AND ITS ASSESSMENT OF POTENTIAL IMPACTS OF A CHANGE IN THE LAW ON MILITARY EFFECTIVENESS, AND IS SCHEDULED TO REPORT ITS RESULTS TO THE SECRETARY OF DEFENSE ON 1 DECEMBER 2010.

5. THE COURT’S INJUNCTION IS VERY BROAD. IT IS NOT LIMITED SOLELY TO SUSPENDING SEPARATIONS, BUT CAN IMPACT A NUMBER OF DOD ACTIONS RELATED TO DON’T ASK DON’T TELL. WE MUST ADJUST ON SHORT NOTICE IN ORDER TO FULLY COMPLY WITH THE COURT’S ORDER. WHAT DOES NOT CHANGE IS THE IMPORTANCE OF ALL HANDS CONTINUING TO TREAT EVERY SHIPMATE WITH DIGNITY AND RESPECT, AND FOR ALL TO REMAIN COMMITTED TO THE GOOD ORDER AND DISCIPLINE THAT ARE THE HALLMARKS OF OUR NAVY.

6. QUESTIONS REGARDING HOW TO COMPLY IN SPECIFIC CIRCUMSTANCES SHOULD BE ADDRESSED VIA THE CHAIN OF COMMAND TO THE APPROPRIATE COMMAND ECHELON HAVING A JUDGE ADVOCATE OR COUNSEL ASSIGNED.     DADT TAKES EFFECT. UNTIL 60 DAYS HAVE PASSED AFTER CERTIFICATION, SECTION 654
    OF TITLE 10, AND ITS RELATED IMPLEMENTING REGULATIONS REMAIN IN EFFECT.
    INDIVIDUALS WHO IDENTIFY THEMSELVES AS HOMOSEXUAL OR BISEXUAL REMAIN BARRED
    FROM ENLISTING OR RECEIVING A COMMISSION, AND SERVICE MEMBERS WHO ENGAGE IN
    HOMOSEXUAL ACTS, MAKE A STATEMENT THAT THEY ARE HOMOSEXUAL OR BISEXUAL (OR

    EFFECTIVENESS, UNIT COHESION, AND RECRUITING AND RETENTION OF THE ARMED

    2. THE DEPARTMENT OF DEFENSE IS ACTIVELY PREPARING FOR FINAL REPEAL. THE
    SERVICES, IN CLOSE COORDINATION WITH THE OFFICE OF THE SECRETARY OF DEFENSE,
    ARE ENGAGED IN THE DEVELOPMENT OF EDUCATION AND TRAINING FOR ALL HANDS.
    WITHIN OUR NAVY, I HAVE DESIGNATED COMMANDER, U.S. FLEET FORCES COMMAND (USFF)
    AS THE EXECUTIVE AGENT FOR TRAINING DELIVERY AND TRACKING AND OPNAV (N1) AS
    THE EXECUTIVE AGENT FOR THE DEVELOPMENT OF CONTENT. SPECIFICS OF THIS TASKING
    WILL BE PROVIDED VIA SEPARATE CORRESPONDENCE.

    3. TRAINING WILL BE PROVIDED TO ALL ACTIVE AND RESERVE PERSONNEL, NAVY
    CIVILIANS WHO SUPERVISE MILITARY PERSONNEL, AND DOD CONTRACTORS, AS REQUIRED
    BY THEIR POSITION AND RESPONSIBILITIES, PRIOR TO REPEAL. WE WILL USE A TIERED
    APPROACH TO ENSURE ALL PERSONNEL WILL RECEIVE THE NECESSARY LEVEL OF TRAINING.
    TIER LEVELS WILL INCLUDE:
    A. TIER 1: TRAINING FOR EXPERTS WHO MAY DEAL FREQUENTLY WITH REPEAL
    ISSUES (CHAPLAINS, JUDGE ADVOCATES, MILITARY LAW ENFORCEMENT PERSONNEL, FLEET
    AND FAMILY SUPPORT CENTER PERSONNEL, PERSONNEL SUPPORT PROFESSIONALS, EQUAL
    OPPORTUNITY ADVISORS, RECRUITERS, SENIOR HUMAN RESOURCES OFFICERS, AND PUBLIC
    AFFAIRS OFFICERS). COMMUNITY LEADERS OF THESE DISCIPLINES WILL HELP DEVELOP
    AND DELIVER THE REQUIRED TRAINING.
    B. TIER 2: TRAINING FOR SENIOR LEADERS AND COMMAND LEADERSHIP
    (CO/XO/CMC) TO PREPARE THEM TO EDUCATE AND TRAIN THEIR COMMANDS.
    C. TIER 3: TRAINING FOR ALL HANDS, WHICH INCLUDES THE ACTIVE FORCE,
    RESERVE FORCE, AND THOSE CIVILIANS WHO SUPERVISE MILITARY PERSONNEL. THIS
    TRAINING WILL EMPHASIZE POLICIES AND EXPECTATIONS OF PERSONAL BEHAVIOR.

    4. U.S. FLEET FORCES COMMAND WILL LEAD DELIVERY OF THE TRAINING TO ALL NAVY
    COMMANDS. METHODS OF DELIVERY WILL BE:
    A. PRIMARY: FACE-TO-FACE DELIVERY. MOBILE TRAINING TEAMS COMPOSED OF
    FLEET REPRESENTATIVES AND SUBJECT MATTER EXPERTS WILL DELIVER THE TRAINING
    FACE-TO-FACE TO COMMAND LEADERSHIP TEAMS (CO/XO/CMC) WHO, IN TURN, WILL
    EDUCATE AND TRAIN THEIR COMMANDS.
    B. SECONDARY: DEFENSE CONNECT ONLINE (DCO) TRAINING. DCO WILL BE USED
    TO REACH GEOGRAPHICALLY ISOLATED SAILORS AND THOSE PERSONNEL ATTACHED TO NON-
    NAVY COMMANDS. THESE SESSIONS WILL BE HOSTED BY A MOBILE TRAINING TEAM WITH
    PARENT COMMAND LEADERSHIP.
    C. TERTIARY: E-SOLUTION. COMPUTER BASED TRAINING WILL BE AVAILABLE FOR
    THOSE PERSONNEL WHO CANNOT ATTEND FACE-TO-FACE OR DCO TRAINING.

    5. COMPLETION OF TRAINING (TIER 1, 2, AND 3) WILL BE DOCUMENTED VIA THE NAVY
    FAMILY ACCOUNTABILITY AND ASSESSMENT SYSTEM (NFAAS), WHICH WILL BE UPDATED TO
    DOCUMENT INDIVIDUAL TRAINING COMPLETION FOR ALL PERSONNEL. ECHELON TWO
    COMMANDERS WILL BE RESPONSIBLE TO USFF FOR EXECUTION AND REPORTING. SPECIFIC

    REPEAL IMPLEMENTATION. THE SERVICES ARE ENGAGED IN THE DEVELOPMENT
    OF IMPLEMENTING GUIDANCE FOR ALL SERVICE PERSONNEL. ON 2 MARCH 2010,
    THE SECRETARY OF DEFENSE DIRECTED THE HONORABLE JEH CHARLES JOHNSON,
    GENERAL COUNSEL OF THE DEPARTMENT OF DEFENSE, AND GENERAL CARTER F.
    HAM, COMMANDER, U.S. ARMY EUROPE, TO “STAND UP AN INTRA-DEPARTMENT,
    INTER-SERVICE WORKING GROUP TO CONDUCT A COMPREHENSIVE REVIEW OF THE
    ISSUES ASSOCIATED WITH A REPEAL OF THE DON’T ASK, DON’T TELL LAW.”
    THE SECRETARY’S TERMS OF REFERENCE REQUIRED TWO DELIVERABLES: 1) A
    REPORT CONTAINING THE CO-CHAIRS’ ASSESSMENT AND RECOMMENDATIONS; AND
    2) A PLAN OF ACTION TO SUPPORT THE IMPLEMENTATION OF A REPEAL OF THE
    LAW. ON 22 DECEMBER 2010, THE PRESIDENT SIGNED INTO LAW LEGISLATION
    THAT SET CONDITIONS FOR THE REPEAL OF DADT POLICY.

    4. RESPONSIBILITIES. DNRI TF WILL PLAN, DELIVER, ASSESS, AND
    DOCUMENT DADT REPEAL TRAINING IN ORDER TO FACILITATE HIGHER LEVEL
    CERTIFICATION AND ENSURE THE NAVY FORCE IS EDUCATED ON NEW POLICIES
    AND EXPECTATIONS OF CONDUCT.

    5. PURPOSE. TO EDUCATE AND TRAIN NAVY PERSONNEL ON THE SPIRIT AND
    INTENT OF THE DADT REPEAL WITH NO IMPACT TO MISSION READINESS.

    6. METHOD. IMPLEMENTATION GUIDANCE WILL BE PROVIDED TO ALL ACTIVE
    AND RESERVE PERSONNEL, NAVY CIVILIANS WHO SUPERVISE MILITARY
    PERSONNEL, AND DOD CONTRACTORS AS REQUIRED BY THEIR POSITION AND
    RESPONSIBILITIES. TRAINING WILL BE PROVIDED VIA THREE METHODS USING
    A TIERED APPROACH TO ENSURE PERSONNEL RECEIVE THE APPROPRIATE LEVEL
    OF TRAINING. THE CENTRAL MESSAGE OF THIS TRAINING WILL FOCUS ON
    LEADERSHIP, PROFESSIONALISM, DISCIPLINE, AND RESPECT.
    A. LEADERSHIP. THIS IS A MAJOR POLICY CHANGE AND FOCUSED
    LEADERSHIP IS REQUIRED TO SET CONDITIONS FOR SUCCESS FOR UNIT
    COHESION, READINESS, AND THE EFFECTIVENESS OF A GIVEN COMMAND.
    FRONTLINE LEADERS ARE TASKED WITH BUILDING UNIT COHESION AND
    MAINTAINING READINESS IN A DIVERSE FORCE TO MEET MISSION
    REQUIREMENTS. BY PROVIDING LEADERS AT ALL LEVELS WITH ACCURATE
    INFORMATION, WE ENHANCE OUR ABILITY TO ENSURE A SMOOTH POLICY
    TRANSITION WITH MINIMAL DISRUPTION TO THE FORCE.
    B. PROFESSIONALISM. WE HAVE TAKEN AN OATH AS MILITARY
    PROFESSIONALS TO SUPPORT AND DEFEND THE CONSTITUTION OF THE UNITED
    STATES AND WE ARE COMMITTED TO OUR NAVY CORE VALUES. EMPHASIZING

    C. DISCIPLINE. THE UNIFORM CODE OF MILITARY JUSTICE (UCMJ)
    EMAINS THE LEGAL FOUNDATION OF GOOD ORDER AND DISCIPLINE. THE UCMJ PROVIDES
    FOR ENFORCEMENT OF STANDARDS OF CONDUCT AND LAWS AND
    PROHIBITS HARASSMENT, SEXUAL ASSAULT, AND OTHER VIOLENCE.
    ACCOUNTABILITY IS A CORNERSTONE OF GOOD ORDER AND DISCIPLINE AND
    WILL CONTINUE TO GUIDE STANDARDS OF ACCEPTABLE BEHAVIOR.
    D. RESPECT. AS LEADERS WE MUST FOCUS ON OUR VALUES AND NAVY TRADITIONS
    AS THE FOUNDATION FOR MAINTAINING THE STRENGTH OF OUR

    PRIMARILY DOCUMENTED VIA THE NAVY FAMILY ACCOUNTABILITY AND
    ASSESSMENT SYSTEM (NFAAS), AUGMENTED BY THE FLEET TRAINING MANAGEMENT
    PLANNING SYSTEM (FLTMPS). NFAAS WILL BE UPDATED TO DOCUMENT
    INDIVIDUAL TRAINING COMPLETION FOR ALL PERSONNEL. ECHELON TWO
    COMMANDERS WILL BE REQUIRED TO VERIFY SUBORDINATE COMMAND TRAINING

    AND ALL TIER 3 TRAINING MUST BE COMPLETED NOT LATER THAN 30 JUNE

    TELL’(DADT). THE PURPOSE OF THIS NAVADMIN IS TO NOTIFY ALL NAVY PERSONNEL OF
    INTERIM POLICY. ON 6 JULY 2011, THE 9TH CIRCUIT COURT OF APPEALS LIFTED A
    STAY ON THE OCTOBER 2010 INJUNCTION (REF A) ORDERING THE DEPARTMENT OF DEFENSE
    TO CEASE ENFORCEMENT OF DON’T ASK, DON’T TELL AND ITS IMPLEMENTING
    REGULATIONS. AT THE PRESENT TIME, COMPLIANCE WITH THE INJUNCTION IS REQUIRED
    THROUGHOUT THE NAVY EFFECTIVE IMMEDIATELY PER REF B.

    2. GUIDANCE:
    A. IT REMAINS THE POLICY OF THE DEPARTMENT OF DEFENSE NOT TO ASK
    SERVICEMEMBERS OR APPLICANTS ABOUT THEIR SEXUAL ORIENTATION, TO TREAT ALL
    MEMBERS WITH DIGNITY AND RESPECT, AND TO ENSURE MAINTENANCE OF GOOD ORDER AND
    DISCIPLINE.
    B. THE NAVY WILL PROCESS APPLICATIONS FOR ENLISTMENT OR APPOINTMENT
    WITHOUT REGARD TO SEXUAL ORIENTATION.
    C. COMMANDERS SHALL CONSULT THEIR SJA OR COMMAND COUNSEL IN EVERY

    1. THIS IS THE 14TH IN A SERIES OF COMMUNICATIONS CONCERNING THE REPEAL OF

    22 JULY, THE PRESIDENT, THE SECRETARY OF DEFENSE, AND THE CHAIRMAN OF THE
    JOINT CHIEFS OF STAFF CERTIFIED TO CONGRESS THAT ALL OF THE MILITARY SERVICES
    ARE READY FOR REPEAL IN A MANNER CONSISTENT WITH THE STANDARDS OF MILITARY
    READINESS, MILITARY EFFECTIVENESS, UNIT COHESION, AND RECRUITING AND RETENTION
    OF THE ARMED FORCES.

    2. REPEAL OF DADT WILL BE EFFECTIVE ON 20 SEPTEMBER, WHICH IS 60 DAYS AFTER
    CERTIFICATION. ADDITIONAL IMPLEMENTATION GUIDANCE WILL BE PROVIDED UPON
    REPEAL.

    3. THROUGHOUT THIS PROCESS, I REMAINED PERSONALLY ENGAGED WITH THE SECRETARY
    OF DEFENSE AND CHAIRMAN. AFTER A COMPREHENSIVE REVIEW OF NAVY’S POLICIES AND
    REGULATIONS AND CAREFUL CONSIDERATION OF TRAINING PROGRESS, SAILOR FEEDBACK,
    AND INPUT FROM COMMAND LEADERSHIP, I INFORMED THEM THAT THE U.S. NAVY IS
